By accessing or using Fizzly AI, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this platform.

Eligibility You must be at least 18 years old to use Fizzly AI. By using our services, you represent and warrant that you meet this age requirement and have the legal capacity to enter into a binding agreement.

Account Responsibility You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

Fizzly AI provides AI-powered content generation tools including:

Image Generation Access to various AI image generation models including Flux, GPT Image, and Nano Banana Pro, enabling creation of images from text prompts.

Video Generation Video creation capabilities using models such as Kling, WAN, and Veo for transforming images and prompts into video content.

Editing Tools Image manipulation features including face swap, image-to-image transformation, upscaling, and image-to-prompt analysis.

Custom Models The ability to train custom LoRA models using your own images for personalized AI generation.

We reserve the right to modify, suspend, or discontinue any aspect of our services at any time with reasonable notice.

Credit System All AI operations on Fizzly AI consume credits based on the complexity and resources required. Credit costs for each operation are displayed before generation.

Purchasing Credits Credits can be purchased through our platform via credit packages or subscriptions. All payments are processed securely through Stripe.

Non-Refundable Credits are non-refundable once consumed. Unused credits do not expire while your account remains active. In cases of technical issues that prevent service delivery, we may issue credit refunds at our discretion.

Pricing Changes We may modify credit pricing with advance notice. Changes will not affect credits already purchased. Subscription pricing changes require 30 days notice before the next billing cycle.

Your Content You retain ownership of original content you create using our platform. By using our services, you grant Fizzly AI a non-exclusive license to store, display, and process your content as necessary to provide our services.

Generated Content AI-generated content created through our platform is subject to the terms of the underlying AI models. You are responsible for ensuring your use of generated content complies with applicable laws.

LoRA Models You own the custom LoRA models you train on our platform. However, you are solely responsible for ensuring that training data does not infringe third-party rights. Models trained on copyrighted content without authorization may be subject to removal.

Platform Intellectual Property Fizzly AI retains all rights to our platform, software, design, and proprietary technology. You may not reverse engineer, copy, or create derivative works based on our platform.

You agree not to use Fizzly AI for any unlawful or prohibited purpose:

Content Restrictions - Illegal content or content promoting illegal activities - Non-consensual intimate imagery of any person - Content depicting minors in any inappropriate context - Content promoting harassment, hate speech, or violence - Content that infringes intellectual property rights - Deceptive content intended to mislead or defraud

Platform Abuse - Automated scraping, harvesting, or data extraction - Circumventing security measures, rate limits, or access controls - Creating multiple accounts to abuse promotions or evade restrictions - Interfering with other users' access to or enjoyment of the platform - Attempting to gain unauthorized access to systems or data

Violation of these terms may result in immediate account suspension or termination.

Service Warranty Fizzly AI is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee uninterrupted, secure, or error-free service.

Limitation of Damages To the maximum extent permitted by law, Fizzly AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill.

Liability Cap Our total liability to you for any claims arising from or related to these terms or your use of our services shall not exceed the amount you paid to us in the twelve months preceding the claim.

Indemnification You agree to indemnify and hold harmless Fizzly AI, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the platform, your content, or your violation of these terms.

Termination by You You may terminate your account at any time by contacting support or through your account settings. Upon termination, your access to the platform will cease.

Termination by Us We may suspend or terminate your account at any time for violation of these terms, illegal activity, or at our discretion with reasonable notice. Severe violations may result in immediate termination without notice.

Effect of Termination Upon termination, your right to access and use the platform immediately ceases. We may delete your content and data after a reasonable retention period, subject to legal requirements. No refunds will be provided for termination due to terms violations.

Survival Provisions regarding intellectual property, limitation of liability, indemnification, and governing law survive termination.

Governing Law These terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

Arbitration Any disputes arising from these terms or your use of our services shall be resolved through binding arbitration administered by the American Arbitration Association, except where prohibited by law.

Class Action Waiver You agree to resolve disputes with us on an individual basis and waive any right to participate in class action lawsuits or class-wide arbitration.

Small Claims Notwithstanding the above, either party may bring an individual action in small claims court for disputes within the court's jurisdiction.

We may modify these Terms of Service at any time. When we make material changes, we will notify you by email at least 30 days before the changes take effect, and post the updated terms on our website.

Your continued use of Fizzly AI after changes become effective constitutes acceptance of the modified terms. If you do not agree to the changes, you should discontinue use of the platform before the effective date.
